TYPES OF DEVELOPMENT
There are 3 types of development under IPA.
1. Exempt development-this is an activity that does not require
development approval and there are no codes or standards applied to
the development and accordingly no assessment of the activity is required.
To find out if your development is exempt go to Schedule 8 of
Integrated
Planning Act 1997.
2. Self-assessable development- this is an activity that does
not require development approval but you are responsible for ensuring
that the proposal complies with any applicable standards or code specified
in any regulatory document.
To find out if your development is self assessable go to Schedule
8 of Integrated
Planning Act 1997 the Building
Regulation 2006 and also
your local Council planning scheme and refer to the Development
Assessment Tables.
3. Assessable development-requires the lodgment of an development
application to a assessment manager for assessment and a decision
using IDAS.
There are 2 types of assessable development under IPA they are:
A. Code assessment-the application is assessed for compliance
with applicable standards called "Codes" (e.g. the Building
Code of Australia: Environmental
Protection Act 1994: Vegetation
Management Act 1999 ).
A development
application is required and fee are payable but Public notification
is not required.
B. Impact assessment-involves a much broader and less objective
process of assessment on the potential effects of the proposal.
In these types of development application an assessment is made against
the local government's planning scheme, any applicable State Planning
Policy and any other laws, standards or scientific evidence that is
reasonable to apply to the development and on many occasion the politics
of community opinion expressed through submissions.
A development
application is required and fee are payable PLUS
Public notification is required and the application is subject
to third party appeal rights in the Planning
and Environment Court .
